우리나라에서의 전략환경평가 논의에 대한 법적검토

초록

A Legal Study of Strategic Environmental Assessment(SEA) in KoreaHahm, Tae-SeongThis Paper aims to review the legal subject of Strategic Environmental Assessment(SEA). SEA can provide useful measures and methods for integrating environmental considerations with spatial and sectoral policies, plans and programmes. Although EIA in Korea has been improved markedly over the past two decades, by enlarging the range of projects for assessment, instituting public participation and environmental monitoring, and similar measures, it remains deficient in its coverage of programmes and plans at the policy level across major sectors such as energy and use. SEA can supply the necessary correctives. I studied relation of Strategic Environmental Assessment(SEA) and PERS. The regulations for PERS have been established by an amendment of the Framework Act on Environmental Policy. According to this law, when the head of any administrative agency concerned intends to develop and determine the administrative plan affecting the environment or to grant permission, etc. for any development project, he shall consult with the Minister of Environment or the head of any local environmental agency(head of consultative agency) about the examination of its impact on the environment, before he determines the administrative plan or grant permission, etc. for the development project. However, the term SEA is variously defined and understood, generally it means a formal process of systematic analysis of the environmental effects of development policies, plans, programmes and other proposed strategic actions. Now, introduction of SEA is discussed actively. However, I do not think that SEA may solve problems of PERS perfectly. SEA and PERS are similarity in purpose or meaning, but there is difference in detailed. However, I think that both are similar system essentially. We must consider harmony with PERS in introduction of SEA
