초록
When a member of institute or company(‘company') creates an invention with the use of facilities and resources of that company, can he have the ownership for the invention? Usually, intellectual property created or developed within the context of a Sponsored Program shall belong to either or both the sponsor and company in accordance with the terms of the Sponsored Program or the rules of that company. Also, the company have the right to use and license the patent of that invention. Then what is the inventor's right? The inventor has not any right to determine the way of the use of invention. Is that fair and desirable? We can say that the right of inventor is more strengthen to promote the invention and get the goal of patent law.
